PART II: TERMS AND CONDITIONS OF USE

ARTICLE 1: PREAMBLE

Thank you for taking the time to read and understand these Terms and Conditions of Use (hereinafter "T&C") of our website "http://www.jeanrogerparis.com/", (hereinafter the "Site").

The Site is owned and operated by the company Jean Roger (RCS 312 009 673), with which you are contracting by accepting these T.C..

To access details about our company, please refer to Part 1 "Legal Notice" above.

Access to and use of the Site constitutes full and complete acceptance of these T.C. by each Internet user browsing all or part of the Site (hereinafter the "User"), who undertakes to comply fully with them for as long as he or she uses the said Site. In the event of disagreement with the terms of these T&C, the User must immediately stop using the Site.

The present T.C. govern the conditions under which the User undertakes to use the Site and the various services offered on it. The present T.C. are complemented - if necessary - by specific contractual conditions, applicable in particular to the sale of products.

ARTICLE 2 : ACCESS TO THE SITE

The user may access the Site freely and without charge, without registering or creating an account. The costs of access and use of the telecommunication network remain nevertheless at his/her expense.

The User acknowledges that he/she has the necessary skills and means to access and use the Site; in particular, he/she acknowledges that he/she has verified that the computer equipment with which he/she connects to the Site (computer, smartphone, etc.) does not contain any viruses and that it is in perfect working order.

The Site is accessible 24 hours a day, 7 days a week, except in the event of force majeure or any other event beyond Jean Roger's control, and in particular, due to technical difficulties. Furthermore, for maintenance reasons, Jean Roger may interrupt access to the Site and will make every effort to inform Users in advance.

Jean Roger is not bound by any obligation of result concerning accessibility to the Site and is in no way responsible for interruptions and the consequences that may result from them. Jean Roger reserves the right to suspend, interrupt or limit, without prior notice, access to all or part of the Site, particularly for updating operations.

The User is informed that Jean Roger may terminate or modify the characteristics of the services offered on the Site, at any time, without prior notice and without the User having any recourse against Jean Roger and/or being able to claim any compensation.

Furthermore, Jean Roger declines all responsibility:

- For any interruption of service that is involuntary or attributable to an event beyond its control;

- For the occurrence of bugs or technical incompatibilities with the User's equipment;

- For any damage resulting from fraudulent intrusion by a third party leading to a modification of the information made available;

- For any damage that may be caused to the User's equipment as a result of accessing this Site and its services, as well as a result of using or downloading any of its elements.

ARTICLE 3: CONTENT AND SERVICES OFFERED ON THE SITE

3.1. GENERAL PRESENTATION

The Site offers the following contents and services (subject to change):

- A catalog of ceramic products marketed by Jean Roger;

- An online store;

- A newsletter;

3.2. RESPONSIBILITY

The information provided on the Site is for information purposes only. Despite all the care and diligence taken by Jean Roger in collecting and updating this information, Jean Roger cannot guarantee its accuracy, precision, completeness or timeliness. Consequently, Jean Roger cannot be held responsible for any damage whatsoever, whether direct or indirect, that may result from the use of information contained on the Site.

The User is invited to verify all information published on the Site and to notify Jean Roger of any errors, omissions or inaccuracies.

3.3. USER'S OBLIGATIONS

The User undertakes to use the Site and the services it offers in strict compliance with these T.C., in particular by refraining from any malicious and/or damaging use of the Site that may have the effect of clogging up, slowing down or disrupting the operation of the Site.

ARTICLE 4 : HYPERTEXT LINKS

Jean Roger may refer to other resources on the Internet network by means of outgoing hypertext links on the Site and for information purposes. Jean Roger cannot be held responsible for these hypertext links. Indeed, the sites linked directly or indirectly to the Site by means of such hypertext links are beyond the control of Jean Roger.

Jean Roger therefore assumes no responsibility for the information published on these sites and the hypertext links thus provided do not imply any guarantee concerning the content of these sites. Jean Roger undertakes, in the event of disagreement or upon simple request from the operator of a referenced site, to remove the hypertext link as soon as possible. These requests must be sent by email to serviceclient@jeanrogerparis.com and mention the words "request for removal of a hypertext link" in the "subject" field of the email.

Concerning incoming hypertext links, Jean Roger may authorize the establishment of a link pointing to its content, provided that it respects the spirit of its Site, which excludes sites disseminating information and/or content of an illegal nature and/or of a polemical, political, religious, pornographic or xenophobic nature or which may, in a general manner, offend the sensibilities of Internet users. Users who place such links to Jean Roger's site undertake to request prior authorization from the latter by contacting it by email at contact@jeanrogerparis.com, specifying the terms "hypertext links" in the "subject" of the email.

Jean Roger is not responsible for the information contained on sites that may be linked to its own site by a hypertext link or by any other means.

ARTICLE 5: INTELLECTUAL PROPERTY

The content of the Site, its general structure, its presentation, as well as the texts, photographs, animated or non-animated images, logos, graphics and/or any other element composing it are covered by intellectual property rights of which Jean Roger is the owner.

Any representation, imitation or reuse, in whole or in part, of the Site, by any process whatsoever, for any purpose whatsoever, without the prior, express and written authorization of Jean Roger, would constitute a breach of contract hereunder as well as, in particular, an infringement punishable by French legislation and international treaties relating to the protection of intellectual property and/or a fraudulent extraction of data punishable by Article 323-3 of the Penal Code.

For any information or request for reproduction or use of a content of the Site (text, photograph, drawing, illustration, ...), whatever the medium, the User must send a prior request by email to the address contact@jeanrogerparis.com indicating the terms "Request for authorization to reproduce" in the "Subject" of this email and wait for a positive response to implement the purpose of his request.

ARTICLE 6: USE OF THE INTERNET

Jean Roger undertakes to take all necessary precautions to preserve the security of the information and in particular to prevent it from being distorted, damaged or communicated to unauthorized persons. The User nevertheless declares that he/she is perfectly aware that, due to the characteristics and constraints of the Internet network, the data circulating on this network is not protected against any form of intrusion, including by piracy, and that it is therefore impossible to guarantee, in an absolute manner, total security of the data transmitted on the network.

Consequently, Jean Roger cannot be held responsible for incidents that could result from a case of force majeure or the fact of a third party presenting the characters of a foreign cause.

It is expressly reminded that the Internet is not a secure network. Under these conditions, it is up to the User to implement, under his/her responsibility, all useful means in order to preserve the confidentiality of the information transmitted on the Internet network. It is therefore recommended that Users handle their personal information with great care, and take all appropriate measures to protect their data and/or software, in particular from contamination by any viruses circulating on the Internet or from the intrusion of a third party into the User's equipment.

ARTICLE 7: GENERAL MEASURES

7.1. PROOF, CONSERVATION AND ARCHIVING

The computerized registers, kept in Jean Roger's systems, in compliance with the rules of security, have value as proof between the User and Jean Roger. In the event of a discrepancy between the User's records and those of Jean Roger, the latter will prevail.

7.2. APPLICABLE LAW - COMPETENT COURT

The present T&C are subject to French law, in their entirety.

In the event of a dispute arising from the interpretation or execution of these T.C., when the User contracts as a merchant, jurisdiction is expressly attributed to the courts of Paris, notwithstanding multiple defendants or third party claims and even for summary proceedings. This provision does not apply in the event of a dispute with a non-merchant, for which the legal rules of jurisdiction apply.

7.3. AMENDMENT OF T.C.

Jean Roger reserves the right to modify, at its sole discretion and without prior notice, the present T.C.. In this case, the new version of the T.C. will be published immediately on the Site and all browsing on the Site, as of the publication of said new version of the T.C., will be fully subject to it.
